What is inside the toolkit

Step-by-step guide (PDF). What PAIA is, what goes into the manual, where to publish it, a checklist to run before you publish, wording for your quote, a yearly review email and a recommended pricing guide.
Client questionnaire (PDF and Word). Eight sections that collect everything the manual needs: business identity, head of business and Information Officer, whose personal information is held, records held, POPIA details, records available without a request, other legislation and how requests are handled. It ends with a declaration for the client to sign.
Three AI prompts. A drafting prompt, a review prompt and a fix-up prompt. They turn the completed questionnaire into a draft Section 51 manual and flag every gap instead of guessing. Use them with Claude, ChatGPT or Gemini.

How it works

Send the questionnaire to your client, or complete it together on a call. Allow 30 to 45 minutes.
Check the answers for gaps and get the owner’s input on anything marked “Not sure”.
Paste the drafting prompt into your AI assistant and attach the completed questionnaire.
Run the review prompt and the fix-up prompt until the open items list is empty.
Give the draft to the business owner to read and approve, ideally with an attorney review.
Publish the manual in the footer of the client’s website and diarise the yearly review.

A PAIA manual should be reviewed at least once a year and whenever something material changes, so one client can become repeat income.

What is a PAIA manual?

A PAIA manual explains what records a business holds and how a member of the public can ask to see them. Section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA) requires private bodies to compile one. Since POPIA came into force, the manual must also describe how the business processes personal information. Most businesses publish it on their website, on a page linked from the footer next to the privacy policy.

Companies, close corporations, partnerships and sole proprietors in South Africa, whatever their size. The temporary exemption that covered many small businesses ended on 31 December 2021. If a business holds records of any kind, assume it needs a manual unless an attorney advises otherwise.

Is the PAIA manual toolkit really free?

Yes. It is free to download and free to use with your own South African clients. It is for your personal use, so please do not resell, share or redistribute the files.

Does a small business or sole proprietor need a PAIA manual?

Yes. The exemption for many small businesses ended on 31 December 2021, so companies, close corporations, partnerships and sole proprietors should assume they need one if they hold records of any kind.

Is the PAIA manual sent to the Information Regulator?

The manual itself is not sent to the Information Regulator automatically. It must be available on request and, if the business has a website, it should be published there.

How often should a PAIA manual be updated?

At least once a year, and whenever something material changes: a new Information Officer, a new address, a new cloud tool, a new type of record or a new country where data is stored. Update the version number and date each time.
